Can Mexico extradite me to the United States?
Yes — the US-Mexico Extradition Treaty of 1978 governs extradition between the two countries, and the corridor is the most active in the Western Hemisphere. What is an Interpol Red Notice — and is it an arrest warrant?
A Red Notice is NOT an international arrest warrant. It is a request from one country, processed through Interpol, asking other member states to locate and provisionally arrest a person. Member states are not legally obligated to comply. Many Red Notices are politically motivated and challengeable through the CCF.
Does Mexico extradite if there is no bilateral treaty?
Yes. Mexico's Ley de Extradición Internacional allows extradition based on diplomatic reciprocity even without a bilateral treaty. The 'no treaty equals safety' myth is dangerous. See our analysis of the no-extradition-treaty myth.
How long does extradition take in Mexico?
Most extradition proceedings take 6-18 months from formal request to surrender, not counting Amparo challenges, which can extend the process by 6-24 months. Provisional arrest can be requested at the start.
Can I get residency in Mexico with a Red Notice?
Legally, yes. A Red Notice is not a criminal conviction. INM frequently denies applications by misapplying Article 43 of the Ley de Migración, but those decisions can be challenged through Amparo and CNDH complaints.
